These terms govern your use of derdiedasgame.com (“the Service”), a German article practice game operated by Linda Vanaga, Switzerland (“the Seller”, “I”, “me”). By using the Service you agree to these terms. If you do not agree, please do not use the Service.

The Service

The Service is a browser-based game for practising German articles (der / die / das), grammatical cases, and exam vocabulary. Much of the game is free; optional paid packs unlock additional content with a one-time payment. No account is required.

Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for anything unlawful, fraudulent, or to send spam;
• infringe intellectual property rights;
• interfere with the Service’s security, probe or scan it, introduce malware, or scrape it at scale;
• resell, redistribute, or reverse engineer the Service or its content.

Intellectual property

The Service and its content (software, word lists, artwork, branding) are owned by the Seller and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service for personal learning. No other rights are granted.

Purchases and payments

Paid packs are one-time purchases — no subscriptions, no renewals. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, and refund mechanics are governed by Paddle’s Buyer Terms.

Restoring purchases

Purchases are linked to the email address you provide at checkout. You can restore your packs on a new device by requesting a one-time code sent to that email. You are responsible for keeping access to that email address.

Availability and warranties

The Service is provided “as is”. I do not guarantee uninterrupted or error-free operation, and I disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law. The Service is a learning aid and does not guarantee exam results.

Liability

To the fullest extent permitted by law, the Seller is not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Aggregate liability is capped at the amount you paid for the Service in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

Suspension and termination

I may suspend or terminate access to the Service in case of material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations.

General

These terms are governed by Swiss law, and the courts of Zurich, Switzerland have exclusive jurisdiction, except where mandatory consumer protection law provides otherwise. I am not liable for delays or failures caused by events beyond my reasonable control. You may not assign these terms without my consent; I may assign them in connection with a merger or acquisition. If any clause is found invalid, the rest remain in force.
